ADHELIX – TERMS OF SERVICE

AdHelix acts as a digital laboratory providing experimental data. Just as in a physical lab, not every experiment yields a conclusive result (Causal Discovery). The Lab provides the tools for research, but the final 'formula' for market success remains an entrepreneurial risk of the user.
1. Acceptance of Terms
By creating an account or accessing the AdHelix platform (the "Service"), you ("User", "Client") agree to be legally bound by these Terms of Service. AdHelix is a product of [Your Company Name]. If you do not agree to these terms, you must immediately cease all use of the Service.
2. Scope of Service
AdHelix provides an AI-driven AdTech analytics suite designed to:
Connect via API to social media advertising platforms (e.g., Meta/Facebook/Instagram).
Ingest, process, and analyze Ad Creatives (images, video frames, text, audio).
Identify correlations and attempt to isolate causal relationships between creative elements and performance KPIs (e.g., ROAS, CTR, CPA).
Provide data-driven recommendations and pattern recognition for creative optimization.
3. Nature of Insights: No Guarantee of Success
3.1. Analytical Discovery Tool: AdHelix is a tool for data discovery and hypothesis generation. We provide insights based on historical data patterns.
3.2. No Performance Guarantee: AdHelix does not guarantee any specific financial or marketing outcomes. We do not guarantee that using the Service will lead to increased profit, higher ROAS, improved CTR, or lower acquisition costs.
3.3. No Guarantee of Causal Discovery: Due to the complexity of advertising auctions and external variables (e.g., "Noise"), AdHelix does not guarantee that causal drivers will be identified for every campaign. If data volume or quality is insufficient, the Service may only provide correlative data or no conclusive findings at all.
3.4. Recommendations Only: All outputs, "winning patterns," or "causal insights" generated by AdHelix are recommendations only. The final decision to deploy, pause, or modify advertising spend remains the sole responsibility of the User.
4. Third-Party Platform Integration
API Dependency: The Service relies on third-party APIs (e.g., Meta Graph API). AdHelix is not liable for service interruptions, data inaccuracies, or policy changes initiated by these third parties.
Compliance: Users must ensure their use of AdHelix complies with the terms of the respective social media platforms.
5. Data Ownership and Usage
User Content: You retain ownership of your original ad creatives and raw performance data.
Processing License: You grant AdHelix a non-exclusive license to process your data to provide the Service.
Model Training: AdHelix may use anonymized, de-identified, and aggregated data to improve its machine learning models and provide industry benchmarking. Your specific competitive data will never be shared with other users in an identifiable format.
6. Limitation of Liability
To the maximum extent permitted by law, AdHelix and its affiliates shall not be liable for any:
Loss of advertising budget or "Ad Spend."
Loss of revenue, profits, or business opportunities.
Direct or indirect damages resulting from "Creative Exhaustion" or algorithm changes on third-party platforms.
Decisions made based on the recommendations provided by the Service.
7. User Obligations
The User is responsible for:
Maintaining the security of their API credentials and AdHelix account.
Ensuring that all analyzed content adheres to intellectual property and advertising laws.
Providing a sufficient volume of data to allow for statistically relevant analysis.
8. Termination and Modifications
AdHelix reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance. We may terminate or suspend access to the Service if these terms are violated.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Zurich (Switzerland), without regard to its conflict of law principles.
